Family law

Switzerland is a confederation of 26 cantons, with legislative competence divided between the confederation and the cantons. Federal law governs family and divorce matters. However, these issues are handled by the courts in different cantons, so procedural law can vary significantly from one canton to another.

In cases of international divorce, complex issues can arise regarding court jurisdiction and applicable law. In some instances, Switzerland will apply the law of another country. For example, if the spouses share a common foreign nationality and one of them resides in Switzerland, the law of their common nationality will apply.

Another area of significant interest is the well-known confidentiality of Swiss banking agreements. It is common for a foreign spouse to seek to freeze accounts held by the other spouse in Swiss banks, but there is an effective procedure for handling such requests.
