The right to access judicial police files

In the Canton of Vaud, the Law on Criminal Police Records of December 1, 1980, provides for the possibility for any person to inquire about the personal information held by the police about them and related to an offense under federal criminal law, with the exception of convictions recorded in the traffic fines register.


To obtain this information, the individual must first verify their identity by providing an official identification document (passport, identity card, or any similar document).


Furthermore, in support of their request, the individual must demonstrate that personal data concerning them is likely to infringe upon their personal freedom.


If the request is successful, the information will be provided to the individual. If they find that any of the information is incorrect, inadequate, or irrelevant, they have the option to request its removal from the judge. In such a case, it will be up to the police to prove the authenticity of the information.


Data that is found to be inaccurate or incomplete will be removed from all known recipients if the request is upheld.


This procedure is free of charge. However, the judge has the option to impose fees ranging from 50 to 150 CHF on the applicant in the case of abusive renewal of a request that has been rejected or declared inadmissible.


Obtaining and checking such information is particularly useful for individuals seeking Swiss citizenship. Indeed, as part of the naturalization applications submitted, officials will review such records.
